Preambule

Terms & conditions of sale

The purpose of the present conditions is to define the terms and conditions of distance selling between the VIP (Venezia International Photo) Festival online site and the Purchaser.

They regulate all the steps necessary for placing an order and ensure the follow-up of this order between the contracting parties. 
Placing an order implies the Buyer's full and irrevocable acceptance of these terms and conditions of sale. 
The Buyer declares that he/she is at least 18 years old and has the legal capacity or parental authorization to place an order on the website. 
 
As part of funding through a professional training program (AFDAS or AGEFICE), all administrative, contractual, and financial management is handled by Campus MANA.
Therefore, the terms and conditions of sale, cancellation, and refund that apply are those of Campus MANA Venezia, available on their official website (https://campusmana.com/en/terms-and-conditions-of-sale/)

Article 2

Online sale of workshops (photographic training courses)

Article 2.1: Training courses - Information on services and availability 

2.1.1. The site presents the essential characteristics of the training courses offered in the online store: 

  • Date and number of days 
  • Presentation of the training subject and topics covered 
  • Introducing the photographer tutors 
  • Prices in euros (all taxes included)

Different rates are available depending on the training formula chosen. 

2.1.2. The Association cannot be held responsible for any errors or omissions in this presentation. Photographs and texts illustrating training courses are for information purposes only and are not contractually binding. 

2.1.3. At any time, the Purchaser may request further information on the nature and characteristics of the training courses offered by sending an e-mail to the following address: contact@veneziaphoto.org.

2.1.4. The training courses offered by the Association are those listed on the site on the day of consultation by the purchaser. Training courses are offered subject to availability. 

2.1.5. In the event of an error in the availability of the reserved training, the Buyer will be informed as soon as possible and will have the option of cancelling the order. In the event of an error in the availability of the training course booked, the Buyer will have the option of exchanging it with a training course of equivalent price, or cancelling the order. In the latter case, the buyer will be reimbursed within thirty (30) days of the date of the request for reimbursement of the workshop fee paid for the purchase on the www.veneziaphoto.org website. This excludes reimbursement of flights and/or accommodation in Venice that the Purchaser may have booked elsewhere.
 

Article 2.2: Registration for workshops

2.2.1. Subject to availability, registration for a training course is only definitively validated once full payment of the course price has been received, in accordance with the terms and conditions proposed on the website. Unless otherwise stipulated in the course description on the website, the list of participants is compiled as and when payment is received. No registration or reservation can be made by telephone. 

2.2.2. In the event of the purchase of a training course by a third party, the participant undertakes to communicate his surname, first name and contact details, as well as confirmation of his choice of training course (particularly in the case of a gift voucher), within the limit of available places, no later than fifteen (15) days after placing the order. 

2.2.3. Any special request or information (health, accessibility, etc.) must be requested by email from the organization. The Association will do its best to take them into account, but cannot guarantee that they will be met, unless confirmed in writing. 
In some cases, special requests may entail additional costs, which the Association will point out. 

2.2.4. In the event that a participant's attitude during training is likely to cause harm, danger or disturbance to one of our trainers, or to another participant, the Association reserves the right to terminate the training in progress at any time, without prior notice. In this case, the participant will not be entitled to any reimbursement and/or compensation for the early termination of his/her training. 

Article 2.3: Number of participants/ waiting list for training courses 

The number of participants is limited to 15 per course.

Article 2.4. Training and right of withdrawal 

In accordance with the provisions of article L-121-25-8 of the French Consumer Code, training courses are not subject to a right of withdrawal. 

Article 2.5. Cancellation of training courses

2.5.1. Cancellation of a training course may be made by a previously registered buyer or participant, provided that the association is informed at least thirty (30) days before the start of the training course, i.e. by March 7, 2022 at the latest.

Cancellations made within the above-mentioned deadline will result in a refund of all sums paid, with the exception of 30% of the workshop price.

After this date, no refund, even partial, will be made.

Any course started must be paid for in full, even if the participant has not shown up.

2.5.2. The Association reserves the right to cancel any scheduled training course if the trainer is no longer able to provide the training, notably due to health conditions. In this case, the Association will refund the full amount of the workshop(s) paid at the time of registration. 

The Association reserves the right to cancel any scheduled training course if the number of registered participants is insufficient up to twenty (20) days before the start of the course. In this case, the Association will work with each participant to find an alternative, equivalent course. However, if no solution is found, the Association undertakes to refund all sums paid at the time of registration. 

Article 2.6. Training - Liability, insurance and protection of minors

2.6.1. Training - Liability and insurance 

Participants bring their own photographic equipment and/or laptops to the course. The Association cannot be held responsible for any damage to their personal equipment.

The participant undertakes to take out and maintain, for the duration of the training course, civil liability insurance covering any direct or indirect bodily, material or immaterial damage likely to be caused by his/her actions or those of his/her employees to the detriment of the training organization, particularly in the case of travel (car, train, boat, etc.) during the training course. 

2.6.2. Training - Liability and insurance for under-age participants 

All registrations of minors must be accompanied by a written and signed agreement from the legal guardian, as well as a health form. In the event of registration without this authorization, responsibility will revert to the minor's legal guardian. The Association reserves the right not to accept minors if the above-mentioned documents are not received by the first day of the course at the latest. 

Article 2.7. Training courses: reproduction and representation rights 

Each participant in a training course assigns to the Association, free of charge, the reproduction and representation rights for any non-commercial use of photographs taken during the course. 

The right to reproduce includes the right to reproduce and/or have reproduced by any technical process, on any medium: paper, digital, electronic, and in any format, the photographs of participants taken as part of the training course, in particular for the purpose of securely storing the images taken. The right of representation, which includes representing and/or having represented all or part of the photographs of the participants taken as part of the training course. 

Article 2.8: Training/protection of image rights 

2.8.1. Training: protection of photographers' image rights. 

Any participant taking photographs during a training course must ensure that the persons photographed give their written consent before any image is taken (and distributed). Model image rights agreements are available from all trainers. ADAP and VIP cannot be held responsible for any distribution. The participant takes his or her photographs on a personal basis and guarantees the Association against any action or recourse that may be brought by any person photographed in breach of his or her image, privacy or any other right that he or she may assert. 

2.8.2. Training courses: protection of participants' image rights 

Registration for a training course implies that the participant agrees to be photographed at the training venue and that the photographs taken may be used to communicate on all media (website, social networks, various paper and digital media) about the training courses organized by the Association for a period of five (5) years. 

Article 3

Contractual documents

A contract includes the following contractual documents: 

  • The present general conditions of sale 
  • The "basket", consisting of the accepted quotation, completed with the information required to identify the buyer (detailed contact details).
  • The invoice 
Article 4

Ordering

Any "basket" validated by the purchaser constitutes an irrevocable acceptance which cannot be called into question except in the cases exhaustively provided for in the present general conditions, in the following articles. 

The Association retains full and complete ownership of the reservation for the training course sold until full payment has been received for all sums due by the purchaser in connection with the order, including fees and taxes. 

The transfer of ownership of a training place purchased from the Association by the purchaser to a third party shall not be assumed by the Association. 

Only the purchaser of the goods will be entitled to access the clauses of these general conditions of sale. 

Article 5

Confirmation by e-mail 

The following contractual information will be the subject of a confirmation e-mail at the latest at the time of delivery: 

  • Your booking reference 
  • Order amount 
  • The delivery or collection method chosen by the purchaser for items in the online store 
  • The payment method chosen by the buyer. 
Article 6

Prices

Prices shown on the site are in euros, all taxes included. Prices are those in force on the day of the order. They take into account the VAT applicable on the day of the order (if applicable). Any change in the VAT rate will be automatically reflected in the prices without prior notice to the Internet user. 

Article 7

Payment methods

 

All orders are payable in euros. Any costs associated with financial transactions are to be borne by the purchaser.

Article 7.1. By credit card (secured)

Validation of the order by means of the credit card number and expiry date constitutes a mandate to pay the total amount of the order. 

Cards accepted on the site: CARTE BLEUE, VISA, MASTERCARD

Credit card details are only kept for the duration of the order processing. 

The Association uses a payment service that incorporates the SSL security standard. 

Confidential data (16-digit credit card number, expiry date) are transmitted encrypted. 

Confidential data relating to the means of payment are not accessible by the Association, but are managed directly by the security service. The Association guarantees that the encryption methods and services used to secure transactions have been authorized or declared in accordance with current legislation. 

The amount of the order is detailed at the time of validation of the payment. In the event of refusal of the card used by the payment center, the order is automatically cancelled. The buyer is invited to print out the proof of transaction, which will appear on the screen once payment has been made. 

Article 8

Personal data

The information requested from the purchaser is necessary for the processing of his/her order and may be communicated to the Association's contractual partners involved in the processing of orders. 

In accordance with the French Data Protection Act of January 6, 1978, purchasers have the right to access, modify, rectify and delete information concerning them, which they may exercise by contacting the Association by e-mail at contact@veneziaphoto.org, or by post at ADAP's address.

Article 9

Cookies

To facilitate your browsing on the site, the Association uses cookies. 

Cookies are files stored on the hard disk of the purchaser's computer, the purpose of which is to indicate the purchaser's visit to the site, when consulting other pages of the website or when revisiting the site, and to record information collected during browsing (pages consulted, dates and times of consultation, etc.).

As the information thus collected by the Association is subject to computer processing, you have the right to access, rectify and delete it under the conditions set out in article 13. 

Article 10

Electronic signature - proof

The validation of the order, combined with the authentication procedure and the protection of all messages, constitutes an electronic signature with the same value between the parties as a handwritten signature. 

Computerized registers, kept in the Association's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. 

Orders and invoices are archived on a reliable and irreversible medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code. 

Article 11

Entire contract

If, for any reason whatsoever, any of these terms and conditions should be declared inapplicable, such inapplicability shall not affect the application of the other provisions of the terms and conditions, and the provision deemed inapplicable shall be replaced by the closest possible provision. 

Article 12

Applicable law - settlement of disputes

These general terms and conditions of sale are governed by French law. Any disputes arising between the parties in connection with the performance or interpretation of this contract shall, failing amicable settlement, be referred to the Commercial Court of Paris. 

Article 13

Modification of the terms and conditions of sale

The Association reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general sales conditions in force on the day of the order will be applied to each order.
